MWDHOSTING Acceptable Use Policy 

Effective Date: 18th January 2019

This Acceptable Use Policy (“AUP”) governs your use of the Services and is incorporated by reference into MWD Hosting’s Terms of Service. Unless otherwise defined, capitalized terms in this AUP have the same meaning as in the Terms of Service. MWD Hosting may update this AUP at any time without notice.

Our Services may only be used for lawful purposes. You agree to comply with all applicable laws and regulations when using our Services. MWD Hosting reserves the right to refuse service to anyone at our sole discretion. Any material or conduct that, in our judgment, violates this AUP may result in suspension or termination of Services, or removal of content, with or without notice.

Failure to respond to a communication from our abuse team within the specified time may result in suspension or termination.

1. Prohibited Use or Content

You may not use the Services to publish content or engage in activity that is unlawful, harmful, or that would subject MWD Hosting to liability, including (without limitation):

• Disclosing sensitive personal information about others
• Storing personal or sensitive health information (e.g., HIPAA data)
• Phishing, identity theft, or fraudulent activity
• Distributing malware, viruses, worms, or Trojan horses
• Hosting Ponzi/pyramid schemes, deceptive marketing, or scam websites
• Promoting or facilitating prostitution or sex trafficking
• Hosting/distributing child sexual abuse material or content harmful to minors (immediately reported to authorities)
• Hosting or distributing pornography or adult content, including escort services
• Unlawful distribution of controlled substances or prescription drugs
• Gambling, selling weapons, firearms, or ammunition
• Promoting violence, terrorism, or hate activity
• Infringing intellectual property or proprietary rights of others

2. Excessive Use of Resources / Network Abuse

You may not use excessive amounts of server or network resources or disrupt other customers. Prohibited activities include:

• Operating file sharing or download sites
• Running processes or scripts that harm system performance
• Using software that interfaces with IRC networks
• Activities that generate excessive traffic or degrade service

3. Unauthorized System Access

You may not use the Services to access or attack networks/systems without permission, including:

• Unauthorized scanning, probing, or bypassing authentication
• DoS/DDoS attacks or participation in botnets
• Intercepting or monitoring traffic without consent
• Using crawlers, bots, or automated scripts to scrape/copy our systems without authorization

4. Storage of Backups

Hosting accounts are intended for websites, not as general backup storage. You may not use Services as a file repository or archive. MWD Hosting may remove such backups with or without notice.

5. Zero Tolerance Spam & Email Abuse

• Sending spam, bulk unsolicited email, or “safe list” mailings is strictly prohibited
• Forged or misleading email headers are not allowed
• Sites advertised via spam (“spamvertised”) may not be hosted on our servers
• Selling, renting, or using purchased contact/email lists is prohibited
• Any account that causes our IP addresses to be blacklisted will be suspended or terminated immediately
• We reserve the right to charge an administrative fee or require clean-up/remediation costs if abuse occurs

6. Bandwidth Fair Usage

MWD Hosting provides unmetered bandwidth under fair usage terms:

• Bandwidth may only be used for lawful purposes except prohibited activities under this AUP
• If usage exceeds fair use levels and impacts other users, we may notify you to reduce usage
• In severe cases, excessive or abnormal usage that impacts other customers may result in throttling, suspension, or termination

7. Liability & Defamation Disclaimer

MWD Hosting is not the publisher of user-generated content hosted on its servers. We do not investigate individual defamation claims; instead, we rely on proper legal processes and court orders. Where a valid court order or competent authority requires removal, we will disable or restrict access accordingly.

8. Enforcement

Violations of this AUP may result in suspension, termination, removal of content, or legal action, with or without notice. We may also:

• Report violations to law enforcement where appropriate
• Disable or block access to prohibited material
• Require remediation or security fixes before restoring service

Enforcement is at MWD Hosting’s sole discretion.

9. Compliance with Laws

You are responsible for ensuring that your use of the Services complies with all applicable laws in your jurisdiction, including those relating to defamation, unsolicited email/spam, privacy, obscenity, and intellectual property.
