MWDHOSTING Terms and Conditions
These Terms and Conditions (“Terms”) govern the use of services provided by MWDHosting (“we,” “our,” “us”). By ordering, using, or accessing our services, you (“you,” “your,” or “Customer”) agree to these Terms. If you do not agree, please do not use our services.
1. Services
MWDHosting provides web hosting, VPS, dedicated servers, domain registration, SSL certificates, and related services. The scope, specifications, and pricing are listed on our website and may be updated, suspended, or discontinued at our discretion. Services are subject to reasonable Fair Use to protect platform stability and other customers.
2. Account Registration & Verification
- You must provide accurate, complete information and keep it updated.
- You are responsible for all activity under your account and for safeguarding credentials.
- We may request identity or payment verification (e.g., government ID) to prevent fraud/abuse. Accounts containing false or misleading information may be suspended or terminated.
3. Payments & Billing
- Fees are payable in advance per the chosen billing cycle.
- Accepted methods: PayPal, credit/debit card, and cryptocurrency (crypto payments are non-refundable).
- Certain charges are strictly non-refundable: setup fees, software licenses, add-ons, and domain registrations/transfers/renewals.
- Invoices must be paid by the due date; late or unpaid invoices may lead to suspension/termination.
- Chargebacks or payment disputes may result in immediate suspension; you agree to first contact us to resolve any billing issues.
4. Refund Policy
7-day money-back guarantee for new hosting services only (unless stated otherwise). Submit refund requests via support ticket within 7 days of initial deployment.
Refunds will be granted if:
- VPS not deployed within 24 hours after payment.
- Residential VPS not deployed within 48 hours after payment.
- Dedicated Server not deployed within 7 working days after payment.
- A service experiences network/power downtime >24 hours.
- A VPS remains unusable/inactive within the above deployment timeframes.
Refunds will not be granted if:
- Service is not Active (e.g., suspended/terminated).
- Server usage exceeds 10% of the monthly bandwidth quota.
- Abuse reports exist or assigned IP is listed on public abuse/RBL databases.
- IP is blacklisted or firewalled by authorities/third parties.
- Order used coupon codes, trial credits, or promotions.
- VPS was self-cancelled via panel without a refund request.
Non-refundable items/conditions:
- Residential VPS once successfully deployed and active (due to unpredictable residential IP behavior). Exception: If deployment exceeds 48 hours without success and you request within the initial period, a refund may be granted.
- Cryptocurrency payments, setup fees, software licenses, add-ons, domains, and SSL.
Processing: Approved refunds are returned to the original payment method (PayPal or card) within 7–14 working days.
5. Acceptable Use & Anti-Spam
You must comply with our Acceptable Use Policy (AUP). Prohibited activities include, without limitation:
- Hosting/distributing illegal content; phishing; malware; command-and-control; doxxing.
- Sending spam/UBE/UCE, running open relays, or otherwise harming IP reputation.
- Unauthorized access, scanning, brute forcing, DDoS/DoS attacks, or network interference.
- Copyright or intellectual property infringement.
- Resource abuse that degrades service for others.
Zero-tolerance anti-spam: If your service or IP is listed/blacklisted due to spam or abuse, we may suspend or terminate immediately. You are responsible for monitoring outbound mail and application security.
6. Service Availability & Maintenance
We aim for 99.9% uptime on shared, VPS, and dedicated services. Scheduled maintenance may occur (we’ll try to notify in advance). We are not liable for outages or degradation caused by events beyond our reasonable control (e.g., upstream/provider failures, RBL listings, DDoS, natural disasters, force majeure).
7. Data, Security & Backups
- You are solely responsible for maintaining current, independent backups of your data.
- Any backups we provide are courtesy only and not guaranteed.
- You are responsible for securing your applications, scripts, and passwords.
- We may request temporary access credentials (e.g., SSH/panel) solely to deliver support, and we handle such data confidentially.
8. IP Addresses & Network
IP addresses are allocated as part of a service but remain our/property provider’s resources; they may change. We do not guarantee email deliverability or third-party IP reputation; RBL/delisting requests and IP changes may incur fees and are not grounds for refunds.
9. Software Licensing & Third-Party Services
Any third-party software (e.g., control panels, OS, security tools) is licensed under the vendor’s terms. Misuse may lead to suspension/termination. We are not responsible for defects or vulnerabilities in third-party software or services.
10. Suspension, Termination & Cancellation
- We may suspend/terminate services for AUP violations, non-payment, fraud, security risks, or unlawful activity.
- We may act without prior notice where immediate action is required to protect the network, customers, or legal obligations.
- You may cancel anytime via the client portal; cancellations take effect at the end of the current billing period unless you request otherwise.
- Data may be deleted upon termination/suspension; ensure you have backups.
- Any refund on cancellation is governed by Section 4 (Refund Policy).
11. Limitation of Liability & Indemnity
- To the maximum extent permitted by law, we are not liable for indirect, incidental, special, punitive, or consequential damages (including loss of profits, revenue, or data).
- Our aggregate liability under these Terms is limited to the fees you paid for the affected service in the last billing cycle.
- You agree to indemnify and hold us harmless from claims, damages, liabilities, and expenses arising from your use of the services, your content, or your violation of these Terms/AUP/law.
12. Privacy & Data Protection
Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, store, and protect personal data.
13. Governing Law & Disputes
These Terms are governed by the laws of Malaysia. You agree to the exclusive jurisdiction of the courts in Malaysia for all disputes arising from or related to these Terms.
14. Changes to these Terms
We may update these Terms from time to time. Updates will be posted on our website and/or client portal; continued use of the services after changes constitutes your acceptance of the updated Terms.
